TERMS AND CONDITIONS
Art Outdoors appreciates your business, and we hope to be able to be of service to you.
We ask you to carefully read our Terms and Conditions outlined below, to ensure you are completely aware and satisfied with our policies and procedures and customer service standards.
By accessing or using our website, you acknowledge that you have read, understood, and agree to abide by these Norfolk Island Art Adventure Terms and Conditions without limitation.
Art Outdoors reserves the right to change these Terms and Conditions at any time. Any changes will become effective immediately.
Please note that discount codes are not applicable to the Norfolk Island Art Adventure.
Scope of the agreement
Art Outdoors offers and sells through this Website: www.artoutdoorswa.com.au (hereinafter the ‘Website’), access to and bookings for Art Outdoors’ calendar of events directly to consumers.
Sales of services offered on the Website are governed by the Terms and Conditions of Sale (hereinafter the ‘Terms and Conditions’). The services offered on the Website are sold by Art Outdoors, which is a company registered under the laws of Australia ABN 99 218 411 337.
Booking Policy
In making a booking you acknowledge that you, any other persons that you are booking for, and any other person that attends in your place, understand and agree to our Norfolk Island Art Adventure Terms and Conditions. Art Outdoors accepts no liability for tour cancellations, medical costs, personal injury, evacuation costs and loss or damage to personal items.
Third Party Providers
On the Norfolk Island Art Adventure Tour, Art Outdoors through the Norfolk Island Travel Centre uses third party providers for certain components of the tour. You agree that whilst you are participating in these tours you are under the care and supervision of the third party operator and any issues arising from your participation is therefore between the third party operator and yourself and Art Outdoors accepts no responsibility.
Unforeseen Circumstances
Art Outdoors reserves the right to change or alter the itinerary or cancel the tour due to circumstances beyond the control of Art Outdoors, such as (but not limited to):
Third party operators making changes to the services they are providing as part of the itinerary of the Art Outdoor's Norfolk Island Art Adventure Tour.
Adverse weather conditions.
Natural disasters.
Threat from terrorist activities.
Political unrest.
Travel Insurance
Art Outdoors recommends you purchase your own Travel Insurance at the time of booking. The Norfolk Island Art Adventure tour travels to Norfolk Island, which is remote island with a degree of personal risk from unforeseen circumstances that may incur loss or damage of personal equipment, medical costs and evacuation.
Art Outdoors also does not accept liability for cancellations as we are a small operator and cancellations can affect us significantly. Therefore is is highly recommended you take out travel insurance and if you choose not to then you do so at your own risk.
Cancellations & Credits
Our prices are in Australian dollars.
The Norfolk Island Travel Centre is the tour organiser and bookings agent, and as such, their Terms and Conditions apply for the cost of the tour, except for the optional art materials. Payment for art materials is being accepted by Art Outdoors and, as such, the following applies:
If you are unable to attend Art Outdoors Norfolk Island Art Adventure tour that you have booked, as the Norfolk Island Travel Centre is the organiser of the tour, their terms and conditions, and cancellation policy applies.
Your booking is transferrable to another person (subject to approval by Art Outdoors) – if you can’t make the tour you have booked for, subject to approval by Art Outdoors, you may send a friend in your place – please contact Art Outdoors to discuss.
Art Outdoors does not accept any responsibility for costs you may incur as a result of booking the Norfolk Island Art Adventure Tour such as additional flights to those included in the tour, insurance excess, etc.
Weather
In the event of inclement weather that prevents either a scheduled event or tour or a scheduled ‘en plein air’ (outside) art session/s from proceeding in the outdoors. In the case of a tour with an outside provider (operator), Art Outdoors and the Norfolk Island Art Tour is subject to the decision made by the operator. In the case of an Art Outdoors en plein air workshop, an alternative option will be provided - either shelter/protection from weather and the session/s will proceed at the time specified on the itinerary or a modified art session will replace the ‘en plein air’ session in an indoor or undercover venue. No refunds or credits will be given if there is a change to an activity based on bad weather conditions.
Consumption of Alcohol
During the tour there are times when you may consume alcohol either provided by the operator or third-party operator or by yourself. You agree to the responsible consumption of alcohol and any anti-social behaviours will not be tolerated. Art Outdoors reserves the right to refuse an offended any further participation in the tour and without refund.
Cancellation of the tour by Art Outdoors
Art Outdoors reserves the right to cancel The Norfolk Island Art Adventure tour should the number of participants be deemed to be insufficient or for any other reason where it is deemed necessary. In this case, you will receive a full refund. Refunds are in accordance to the manner in which the payment was made.
Disclaimer and limitation of liability
The purchaser agrees that the provision of any service, including but not limited to the Norfolk Island Art Adventure tour, purchased from our website via the Norfolk Island Travel Centre is at the Purchaser’s sole risk. To the full extent permissible by applicable law, Art Outdoors will not be liable for any damages of any kind and nature whatsoever which may arise out of, or in connection with the use of this site or equipment provided by Art Outdoors or participating in the events, including but not limited to direct, indirect, incidental, punitive, and consequential damages. No oral advice or written information given by Art Outdoors shall create a warranty or legal obligation; nor shall the purchaser rely on any such information or advice.
Photography and Videography
By taking part in an event you grant Art Outdoors full rights to use the images resulting from the photography/video filming and any reproductions or adaptations of the images for promotional purposes. This might include (but is not limited to), the right to use them in their printed and online publicity, social media, and press releases.
If you do not wish for your image to be recorded, we ask that you notify us no later than at the starting time of the session.
PRIVACY POLICY
Art Outdoors is committed to protecting your privacy and this privacy statement applies to the information that we collect from you when you subscribe on our website or make a booking for one of our events.
Art Outdoors shares information with Squarespace, our website hosting provider, so they can provide website services to us. It will not provide any information that you submit or your contact details to any other third parties unless you give us your express consent or we are required to do so by law. Further, Art Outdoors will not use your contact details to contact you for any purpose outside of you receiving updates from us from time to time and to contact you in relation to your booking unless you give us your express consent.
